These Terms and Conditions (“Terms”) govern your use of the Volans Limited website (volans.co.nz) and the purchase of goods and services from us. By accessing our website or placing an order, you agree to be bound by these Terms.

1. About Us

Volans Limited (“we”, “us”, or “our”) is a New Zealand company that sells outdoor, camping, and recreational products. All references to “you” or “your” refer to the customer.

2. Acceptance of Terms

By placing an order or using our website, you confirm that you have read, understood, and agree to these Terms. A binding contract is formed once we accept your order.

3. Products and Pricing

  • All prices are in New Zealand Dollars (NZD) and include GST.
  • We make every effort to ensure product descriptions and prices are accurate. However, errors may occur. If we discover an error in pricing or product information after you place an order, we reserve the right to cancel the order and refund any payment made.
  • Product images are for illustration purposes only. Actual products may vary slightly.

4. Placing an Order

  • When you place an order, you are making an offer to purchase the goods.
  • We reserve the right to accept or decline any order for any reason, including if products are out of stock, incorrectly priced, or if we suspect fraudulent activity.
  • Once we accept your order, we will send you a confirmation email. This confirmation constitutes acceptance of your order.

5. Payment

  • Payment must be made in full at the time of ordering.
  • We accept Visa, Mastercard, and other payment methods displayed at checkout.
  • We do not store your credit card details. All payments are processed securely through our payment provider.

6. Delivery

  • We aim to dispatch orders from our Auckland warehouse within 1–2 business days (subject to stock availability).
  • Delivery times within New Zealand are generally:
    • 2–3 business days for main centres
    • 2–6 business days for rural addresses
  • Delivery times are estimates only. We are not liable for delays caused by couriers or circumstances beyond our reasonable control.
  • Risk in the goods passes to you once the goods are delivered to your nominated address.

7. Title and Risk

Title to the goods passes to you once we have received full payment. Risk passes to you upon delivery to your address.

8. Returns and Refunds

Please refer to our separate Returns and Warranty Policy for information about returns, exchanges, and refunds. This policy forms part of these Terms.

9. Consumer Guarantees Act 1993

If you are purchasing goods or services for personal use, you may have rights under the Consumer Guarantees Act 1993. Nothing in these Terms excludes or limits your rights under that Act where it applies.

If you are purchasing goods or services for business purposes, the Consumer Guarantees Act 1993 does not apply, and these Terms will govern our relationship.

10. Liability

To the extent permitted by law:

  • We exclude all warranties, representations, and guarantees (whether express or implied) except as required by law.
  • We are not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of our products or website.
  • Our total liability to you is limited to the price paid for the relevant goods.
  • We are not responsible for any injury, loss, or damage resulting from the improper use, misuse, or modification of any products purchased from us.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited by law.

11. Intellectual Property

All content on our website, including text, images, logos, and product descriptions, is owned by or licensed to Volans Limited. You may not copy, reproduce, or distribute any content without our prior written permission.

12. Website Use

You agree not to:

  • Use our website for any unlawful purpose
  • Interfere with the operation of the website
  • Attempt to gain unauthorised access to any part of our systems

We reserve the right to suspend or terminate access to our website if we reasonably believe you have breached these Terms.

16. Governing Law
